SECTION 1 - OVERVIEW & ACCEPTANCE

Welcome to Torque Athletics! The terms “we”, “us” and “our” refer to Torque Athletics. These Terms of Service (“Terms”) govern your use of our website, tools, and the purchase of any products (the “Services”). By using our Services, you agree to these Terms. If you do not agree, please do not use our site or purchase our products.

SECTION 2 - ELIGIBILITY & ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction.

  • Account Security: You are responsible for all activity under your account.

  • Accuracy: You warrant that all info provided (email, billing, etc.) is accurate and current.

SECTION 3 - PRODUCTS & PHYSICAL RISK

We strive for accuracy, but please note:

  • Display: Colors and textures may vary depending on your monitor settings.

  • Availability: We reserve the right to limit quantities or discontinue products at any time without notice.

  • ASSUMPTION OF RISK: Torque Athletics provides fitness gear and apparel. Physical exercise involves inherent risk of injury. By purchasing and using our equipment, you acknowledge and voluntarily assume all risks of injury and agree that Torque Athletics is not liable for injuries resulting from use, misuse, or participation in physical activity while using our products.

SECTION 4 - ORDERS & FRAUD PREVENTION

Your receipt of an order confirmation does not signify our acceptance of your order.

  • Right to Refuse: We reserve the right to refuse or cancel any order. This includes orders flagged by our fraud prevention systems or those placed by unauthorized dealers.

  • Cancellations: Due to our automated fulfillment processes, we may be unable to modify or cancel an order once it has been placed.

SECTION 5 - SHIPPING, TITLE & RISK OF LOSS

  • Estimates Only: All shipping dates provided are estimates and are not guaranteed.

  • Transfer of Risk: Risk of loss and title for items passed to you upon our delivery to the carrier. Torque Athletics is not responsible for packages marked as "Delivered" that are subsequently lost or stolen.

SECTION 11 - DISCLAIMER OF WARRANTIES

THE SERVICES AND PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE'. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

SECTION 12 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, TORQUE ATHLETICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR PRODUCTS. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

SECTION 14 - DISPUTE RESOLUTION & ARBITRATION

  • Mandatory Arbitration: Any dispute arising from these Terms will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) in Clarksville, Tennessee.

  • Class Action Waiver: You waive the right to participate in a class-action lawsuit or class-wide arbitration.
